WAC to file suit against Fresno St., Nevada, MWC

The WAC already knew they would be losing the Boise State Broncos to the Mountain West Conference, but they were caught off guard to hear before the season that Fresno State and Nevada had also made plans to make the same move.  The conference, which will be left severely crippled with the exit of three teams, has decided to take legal action against the departing universities.  

The Reno Gazette-Journal reported Tuesday that the WAC will file a lawsuit against Fresno State, Nevada, and the Mountain West Conference.  
The lawsuit, through the Golden, Colo., office of Bradley, Devitt, Haas & Watkins, claims more than 20 allegations. It was filed in District Court in Jefferson County, Colorado.

A message left with attorney Jon Bradley was not immediately returned.  

The WAC is seeking that Nevada and Fresno State not withdraw from the conference before June 30, 2012, that all defendants (including the Mountain West) be prohibited from scheduling contests that interfere with games to be played against remaining WAC members through 2011-12, and for further relief as the court sees just.

The Gazette-Journal contacted a representative from Nevada who confirmed that the university had received the lawsuit and indicated that they were "disappointed" that the suit was filed before any discussions had taken place.  Nevada and Fresno State accepted the Mountain West Conference's invitation to join the conference on August 13.

One of the fire-starters in this in western realignment was BYU's move to football independence, which will occur officially on June 30, 2011.  When the rumors of BYU's independence began, the Mountain West Conference was quick to act to try and replace them.  The WAC was hoping to at least get BYU's other sports, but the Cougars decided to take a majority of those teams (including basketball) to the West Coast Conference.

  The problem isn't Nevada and Fresno leaving, it's that they left so late in the game when WAC requires a 7/1 deadline (see BSU leaves WAC before 7/1).  With Nevada and Fresno leaving, WAC can't replace them by next season, effectively killing the WAC, because all the other conferences also have deadlines long past to announce intention to leave.  The 7/1 deadline has been in the WAC By-Laws forever.  They're not even asking for the money in the lawsuit, they're asking the courts to force them to stay in for one more year so they can have a full football schedule next season.

Dude, again, you're confusing the $5 million issue with WAC By-Laws.  The lawsuit doesn't even ask for the money, but for the schools to be forced to comply with conference By-Laws that have been in effect forever. 

There is nothing illegal, unethical or immoral about Benson negotiating with BYU or any other MWC teams, just like there's nothing illegal, unethical nor immoral about Thompson inviting Fresno and Nevada.   Benson and Thompson have done nothing wrong.

There's also nothing wrong with doing what's best for your conference nor doing what's best for your school.

YOU ALL ARE CONFUSING THE $5 million clause with

the original WAC by-laws.  The $5 million clause was hastily put together after BSU left the WAC in order to give BYU's non football sports a landing place.  That is probably not enforceable, one of the teams that left didn't sign it, I can't remember which one.

But the WAC By-Laws states you must withdraw prior to July 1 of any given year if you're going to leave.  That's been in the WAC by-laws since Adam, and if you leave after July 1 you're legally out of compliance.  I don't know what the penalty is, there may not be one.  The lawsuit filed by the WAC does not ask for the $5 million, but a court injunction forcing Nevada and Fresno to stay in the WAC until the following year, giving the WAC time to find new schools

For all you BYU haters, the only school that has done anything dishonest or lacking in integrity, playing both sides of the deal, so to speak, based on facts instead of conjecture, was Fresno, who knew about BYU's plan to come with the WAC, agreed to it while negotiating with MWC at the same time.

Hawaii needs to go Indy, La Tech needs to go to Conf USA, Utah State and Houston need to go to MWC giving them 12, NM State could probably go Sun Belt or Conference USA, and last but not least the Big Sky has 11 members now, the Idaho Vandals could return to where they belong and give the Big Sky 12.  This lawsuit is at best stupid and needs to be thrown out.

Heres the deal.  As soon as the WAC started having discussion with BYU coming into the conference with all sports other than football, they instituted the new byout contract.  This was to ensure that no program would leave therefore jeapordizing the addition of BYU.  However, the byout clause clearly states that the 5 million dollars only applies to the FIRST school that leaves early.  After that, any school is free to leave without paying the 5 million.  This is why Fresno is saying it should split the cost with Nevada at the very most because technically they did not except the invitation until after Nevada.  Nevada's issue is that they never signed the byout clause to begin with.  Carl Benson is saying that while they may not have signed the clause, they gave verbal committment over the phone wich apparently is binding in the state of Idaho.  Thats the deal, that's where were is with all of this.

As far as Carl Benson goes, what a shiesty S.O.B.  Not only does he try to back door the MWC with under the table deals with BYU, but he tries to secure the deal by forcing the remaining WAC schools to remain in the conference or pay a huge byeout?  That's totoal B.S.  Then turn around and call them selfish for leaving the conference?  That's right Carl Beson, we should all stay is this crappy conference forever beceause it's done so much for the programs.  The WAC has done nothing for BSU nor has BSU done anything for the WAC.  It's a horrible conference any way you look at.  Yes Fresno has a good team and fears NO ONE.  Year in and year out they continue to schedule hard, ranked BCS opponents for there ooc games.  Show some respect.  Nevada has a decent program for a lot of years, most impressively last year with 3 thousand yard rushers, 1 being the quarterback.  They may not be BSU, they have been no. 2 in the conference for a lot of years.  Minus 07's hawaii.  While both schools may not be huge additions to the WAC, they both deserve to move up from the WAC.  Have some class Carl Benson.

This is absolutely awesome!!!  I LOVE that BYU spurned crybaby Karl Benson and went independent!  All of Karl's shifty back room deals fell through and he is left holding the empty bag.  Now he wants to be a poor loser by messing with other teams bailing out of his sinking ship...sad.  I am a Boise State Alum and I wish all the best to Fresno and Nevada.  They are great programs and great schools that deserve to be in the MWC.  Kudos to them to also realize that they had no future in Karl Benson's pathetic conference.  I hope you win the suit Wolfpack and Bulldogs!  Welcome to the MWC!!

If the WAC can hold on long enough they can pick up Kansas, Kansas ST. and maybe Iowa ST. and Missouri. It won't be too long before finishes off the Big 12(-2) and goes Independent andthe rest of them join the SEC in the new super-conference future.

Why just these teams? Why not include Boise State in the lawsuit?Because Boise State announced their departure before the deadline.
